These Terms of Service ("Terms") govern your access to and use of Lokavine ("Service"), operated by Zephyr Advisory Group LLC ("Company," "we," "us," or "our"), accessible at lokavine.com and zephyradvisorygroup.com. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Lokavine is a SaaS platform that helps local service businesses manage their online presence. The Service includes AI-powered blog content generation, Google Business Profile management, review monitoring, performance tracking, and AI search visibility monitoring.

To use the Service, you must create an account by providing accurate and complete information, including your email address and business details. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

The Service uses artificial intelligence (Anthropic Claude) to generate blog content and other written materials for your business. The Service also queries AI search engines (Perplexity and Anthropic Claude) to monitor whether your business appears in AI-generated search results. You acknowledge that:

• All content generated by the Service is written with AI assistance and may require your review before publication.
• AI-generated content may contain inaccuracies. You are responsible for reviewing and approving all content before it is published on your behalf.
• We do not guarantee that AI-generated content will achieve any specific business outcome.
• Published blog posts may include a disclosure that content was written with AI assistance.
• AI search visibility monitoring sends your business name, city, state, and industry to third-party AI search providers to check for mentions. Results reflect AI-generated responses and may not match actual user experiences.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any part of the Service or its systems.
• Use the Service to generate misleading, defamatory, or fraudulent content.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Resell, sublicense, or redistribute the Service without written consent.

Paid subscriptions are billed through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' notice. You are responsible for any taxes associated with your subscription.

The Service, including its design, code, and branding, is owned by Zephyr Advisory Group LLC and protected by intellectual property laws. You retain ownership of the business information you provide. For AI-generated content created through the Service, you are granted a non-exclusive, perpetual license to use, modify, and publish that content for your business purposes.

You may provide business information, approve or modify AI-generated content, and submit other materials through the Service. You represent that you have the right to provide such content and that it does not violate any third-party rights. We may remove content that violates these Terms.

The Service integrates with third-party services including Google (OAuth, Search Console, Business Profile), Stripe (payments), Anthropic (AI content generation and AI search monitoring), Perplexity (AI search monitoring), and others. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability or actions of third-party services.

To the maximum extent permitted by law, Zephyr Advisory Group LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated content will be accurate or suitable for any particular purpose.

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion, with or without notice. You may cancel your account at any time through the Service settings. Upon termination, your right to use the Service ceases immediately. We may retain your data as described in our Privacy Policy.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Delaware.
